A Trade Dispute, From Complaint to Panel

Two countries disagree about a tariff. Matthias follows the dispute through the WTO process with a former panellist, from the request for consultations to the report and what happens if it is ignored.

  • The request for consultations and the 60 days that follow
  • How a panel of three is composed and who can object
  • Written submissions, hearings, and the questions panels actually ask
  • The report, the appeal, and the current state of the appeals body
  • Compliance, retaliation and the limits of enforcement

Matthias has posted a timeline of a real dispute on the Witspeak page for listeners who want the dates.

Welcome back to The Geneva Corridor, I am Matthias Keller. Today we leave New York and go to Geneva, to a building beside the lake where trade disputes are heard. Two countries disagree about a tariff. One of them files a request for consultations, and from that moment a clock starts. We are going to follow the whole process with a former panellist: the 60 days of talks, the composition of a panel of three and who can object to a name, the written submissions, the hearings, and the kind of questions a panel really asks. Then the report, the appeal, and the honest question of what a ruling can force a government to do, which is less than most people assume and more than nothing. You are listening on Witspeak Podcasts.
